The instructing party or, in the case of a counter-guarantee, the counter-guarantor, shall indemnify the guarantor against all obligations and responsibilities imposed by foreign laws and usages, including where those foreign laws and usages impose terms into the guarantee or the counter-guarantee that override its specified terms.
A guarantor using the services of another party for the purpose of giving effect to the instructions of an instructing party or counter-guarantor does urdg icc publication no.758 for the account and at the risk of that instructing party or counter-guarantor. Neither the demand nor the supporting statement may be dated before the date when the beneficiary is entitled to present a demand.
